About Restraining Orders

When someone is the victim of domestic abuse, or is threatened with some form of abuse, a person can file for a restraining order to protect themselves from that individual.  In Iowa there are three types of domestic violence protective orders: 

Emergency Order - Emergency orders are issued when the courts are not available, such as weekends or nights.  The emergency order lasts for 72 hours, allowing a person enough time to file for a temporary or permanent order. These are granted in situations where someone feels that he or she is in immediate danger.  Our family law attorneys at the McGuire Law Firm can assist you with obtaining this type of restraining order.

Temporary Order -Similar to an emergency order, a temporary restraining order lasts longer and is obtained through a judge.  It allows you enough time to schedule a court hearing to apply for a permanent order.

Permanent Order - Once a court hearing is set, both you and the accused abuser have a chance to present the situation to the judge.  Once granted, a permanent restraining order is good for up to one year.
